Official Rules
NO PURCHASE NECESSARY Open Only to U.S. Legal Residents
1. INTRODUCTION: The "Free Labor" Giveaway is sponsored by National Fix and Flip Network, Inc., a Colorado Corporation ("National Fix and Flip Networks"), PO Box 621910, Littleton, CO 80162.
2. SWEEPSTAKES PERIOD: Entries for the "Free Labor" Giveaway may be submitted beginning on August 11th, 2009, and ending on December 10th, 2009, at 5:00 PM MST (the "Promotion Period"). All entries must be received during the Promotion Period. One (1) Grand Prize winner will be selected by random drawing drawn to be conducted on or about December 31st, 2009. By participating, you agree to these Official Rules. Restrictions apply as provided below.
3. PRIZES: The Grand Prize will consist of a gift certificate to ServiceLive to be used for labor, with an approximate retail value of $5,000.00.
4. PRIZE RESTRICTIONS: All taxes, fees, and insurance expenses, if any, are the sole responsibility of the winner. No prize substitution, cash substitution, assignment or transfer of the prize is permitted.
5. ELIGIBILITY: The "Free Labor" Giveaway is open only within the territorial United States, excluding Puerto Rico, to legal residents in the 50 states who are 18 years of age or older at the time of entry as confirmed by a valid government-issued photo identification. Employees of National Fix and Flip Network, or any of their subsidiaries or affiliates, as well as their consultants, agencies and employees, and the immediate families (spouses, parents, children, siblings) and household members of such employees are not eligible.
6. HOW TO ENTER: NO PURCHASE NECESSARY. Purchasing does not improve your chances of winning. Visit www.nfafn.com and go to the sweepstakes section to find the "Free Labor" Giveaway. Agree to the terms and conditions, input your email address and then click on the "register here"™ button. You will then be forwarded to the registration/entry page where you will set up your free ServiceLive account at the same time you will be entered into the "Free Labor" Giveaway. You must sign up for your free ServiceLive account in order to utilize the $5000 grand prize gift certificate thru ServiceLive. You must complete the registration/entry form in its entirety to enter and by doing so agree to setting up a free ServiceLive account. By completing the registration/entry form, you are agreeing to be notified by e-mail if you are the winner of the "Free Labor" Giveaway. All parts of the entry must be filled out correctly; incomplete or illegible entries, or entries received through impermissible or illegitimate channels, are void. Proof of sending will not be deemed to be proof of receipt by National Fix and Flip Network. Only one (1) entry per person is permitted. Duplicate entries will be voided. You may not exceed this limit by entering with different contact information. Entries are not valid unless the registration/entry form is completed properly and a valid e-mail address is provided. Entries are the property of National Fix and Flip Network and will not be returned. In the unlikely event that National Fix and Flip Network encounters technical or equipment failures such as computer systems failure or human error in connection with the sweepstakes, National Fix and Flip Network will not be held responsible. Collection and handling of personally identifiable information will be in accordance with the National Fix and Flip Network Privacy Policy.
7. SELECTION OF WINNERS: Winners will be selected in a random drawing conducted by National Fix and Flip Network from all eligible and valid entries received. Odds of winning depend upon the number of entries received. Winners will be notified within ten (10) days of the drawing by certified mail, return receipt requested, addressed to the home address provided on winner's entry form. Winner also will be notified via electronic mail, at which time his/her e-mail address will be confirmed. Before receiving any prize and as a condition of receiving such prize, the winner will be required to complete and return an affidavit of eligibility and a liability and publicity release within fourteen (14) days of attempted delivery. If the winners fail to sign and return the required documents within fourteen (14) days of the date on the notification letter, do not accept the prize, or fail to meet any eligibility requirement herein, an alternate winner will be chosen by random drawing to be held as soon as reasonably practicable thereafter. Alternate winner is subject to all eligibility requirements and restrictions of these Official Rules. By accepting the prizes, winners agree that National Fix and Flip Network, its subsidiaries, affiliates, distributors, advertising and promotional agencies and suppliers and all of their respective officers, directors, employees, representatives and agents shall have no liability for, and shall hold all such parties harmless against any claim, damage, loss or injury that may arise in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of prizes or participation in this Sweepstakes. National Fix and Flip Network will furnish to the Internal Revenue Service any required tax reporting forms relating to the award of the prize including Form 1099-MISC.
8. MISCELLANEOUS: This sweepstakes is subject to all applicable federal, state, provincial and local laws. Void where prohibited: you may not participate in any state or jurisdiction where this sweepstakes is prohibited by law. National Fix and Flip Network shall be entitled to interpret these rules as needed - including but not limited to rules regarding entries, selection of winner, deadlines, restrictions on the prize, and eligibility - and all of its decisions are final. By entering, you agree to these conditions. You agree that National Fix and Flip Network, and any subsidiaries and affiliates, and their consultants, agencies and employees, and any telephone network or service provider shall not be responsible for incorrect, inaccurate or incomplete transcription of entry information; for lost, stolen, late, or misdirected entries; for incorrect e-mail addresses or bounced-back e-mail messages; for destruction or alteration of entries; for unauthorized access to entries; or for any human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software, inability to access any web site or online service, or any other error or malfunction. Proof of sending an entry will not be deemed to be proof of receipt by National Fix and Flip Network.
9. VIOLATIONS OF RULES: National Fix and Flip reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process or the award mechanism, whether on-line or by any other means, or to be acting in violation of these rules.
10. LIMITATION ON LIABILITY: You agree that National Fix and Flip and any of its subsidiaries and affiliates, as well as any of their consultants, agents and employees, and any service provider will not be liable for any claim, injury, loss or damage of any kind (including but not limited to damage to computer equipment) resulting from participation in this sweepstakes or the acceptance or use of the prize. You further agree that National Fix and Flip Network and any subsidiaries and affiliates are not responsible for typographical or other errors in the offer or administration of this sweepstakes, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prize. National Fix and Flip Network reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the sweepstakes.
11. IMPAIRMENT OF INTEGRITY OF SWEEPSTAKES: If for any reason this sweepstakes or any portion thereof is incapable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, strike, act of God, or any other cause beyond the control of National Fix and Flip Network, National Fix and Flip Network reserves the right, at its sole discretion and without obligation or prior notice, to cancel, terminate, modify or suspend the affected part of the sweepstakes. In such event, National Fix and Flip Network will conduct a drawing to award the prize using all entries received as of the time of cancellation, termination, modification or suspension.
12. WINNER'S NAME: Winners’ name may be posted on the National Fix and Flip Network’s website at www.nfafn.com for a minimum of 14 days, after which it may be removed.
13. BINDING ARBITRATION: By entering the drawing, the entrant agrees that any and all claims against National Fix and Flip Network, its affiliates, employees, officers, directors, judges and agents, arising out of this drawing shall be settled by final and binding arbitration before the American Arbitration Association in Orange County, California. Any such claim must be filed with the American Arbitration Association within one year after the date that the names of the winners have been posted, or no claim or action may be sustained against National Fix and Flip Network Corporation, its affiliates, employees, officers, directors, judges and agents, arising out of this drawing.
14. PRIVACY POLICY: Subject to the third sentence of this paragraph 14, you specifically acknowledge and agree that National Fix and Flip Network, or any of its subsidiaries or affiliates, may utilize information obtained from you in order to contact you and/or to offer their products or services or for other promotional purposes, including online announcements, and as otherwise permitted by their privacy policies. That authorization includes authorization to National Fix and Flip Network, or any of its subsidiaries or affiliates, to provide information about our products and services via email, postal mail, fax and telephone. Participant may “opt-out†of receiving such information and the authorization provided in the preceding sentences at any time, including by stating in writing your election to opt out at the time of submission of your entry. For further information, please refer to the Privacy Policy for the website. If you would like to have your name removed from future mailings by National Fix and Flip Network, you may notify National Fix and Flip Network at the following address: PO Box 621910, Littleton, CO 80162. By accepting a prize, winner consents to the use of his or her name, photograph (including the use and appearance of winner's photograph on the web pages of National Fix and Flip Network(its affiliates or subsidiaries), likeness, biographical information, voice, and e-mail address in this and future promotions and publicity without further compensation, except where prohibited by law.
